The Immigration Reform and Control Act
(IRCA) legally requires that U.S. employers
verify the employment eligibility status
of newly-hired employees and makes it unlawful
and expensive* for employers to knowingly
hire or continue to employ unauthorized
workers. The Professional Employee
is an authorized Designated Agent by the
Department of Homeland Security (DHS) and
is able to check your candidates’
documents through DHS and Social Security
Administration (SSA) databases and provide
employers with a unique DHS-issued verification
number and SSA automated confirmation/non-confirmation. This unique verification system can also
help you identify current employees with
fraudulent Social Security numbers through
the SSA’s Employee Verification Service
(EVS).
HOW THE VERIFICATION
SERVICE WORKS:
As your Designated Agent, we will obtain
appropriate information on all newly hired
employees’ I-9 Forms and then via
a secure, web-based system, conduct Form
I-9 employment eligibility verifications
through the DHS and SSA databases, which
will enable the verification of the accuracy
of Social Security Numbers, Immigration
“A” numbers, and I-94 arrival/departure
numbers and in real-time obtain employees’
legal right to work status with a DHS-issued
verification number.

* Following is a partial list
of federally mandated fines:
- For employers who fail to properly
complete, retain, or make I-9 Forms available
for inspection, fines range from $100
to $1,100 per individual I-9.
- For employers who knowingly hire
or knowingly continue to employ unauthorized
workers, civil penalties range from $250
to $11,000 per violation.
- For employers engaging in a pattern
or practice of knowingly hiring or continuing
to employ unauthorized workers, criminal
penalties can be as much as $3,000 per
unauthorized employee and/or 6 months
of imprisonment.
